JetQuest Terms & Conditions

These Terms & Conditions ("Terms") are a legally binding agreement between you and JetQuest Travel LLC, a Texas limited liability company ("JetQuest," "we," "us," or "our"). They govern your use of jetquest.net, the JetQuest mobile application, and your booking of and participation in any JetQuest trip, event, or experience (collectively, the "Services"). Please read them carefully. They contain an arbitration provision and class action waiver that affect your legal rights.

You accept these Terms by doing any of the following: creating a JetQuest account; checking an agreement box at booking or checkout; submitting payment for any trip, event, membership, or product; or participating in any JetQuest trip or event. JetQuest uses a two-tier consent model: (a) account-level consent, given when you create an account or first use the Services, and (b) per-trip consent, given each time you book a trip. Both apply to you. If you do not agree to these Terms, do not use the Services.

JetQuest curates and hosts group travel experiences and operates a platform connecting travelers ("Travelers") with trip hosts ("Hosts"). JetQuest also offers memberships (including the Founders Circle), events, an affiliate program, and merchandise. Certain offerings are governed by additional agreements (for example, the Founders Circle Member Agreement); where an additional agreement applies, it controls for that offering and these Terms fill any gaps.

You must be at least 18 years old and legally capable of entering a binding contract to use the Services or book a trip. By using the Services you represent that this is true.

JetQuest may use third-party platforms and processors — including booking platforms (such as SquadTrip) and payment processors — to facilitate bookings and payments. Those platforms have their own terms. Where any third-party platform's terms conflict with these JetQuest Terms with respect to your relationship with JetQuest, these JetQuest Terms control. Your agreement with JetQuest is with JetQuest Travel LLC, regardless of which platform processes your booking or payment.

All prices are stated at checkout. A booking is confirmed only when payment is received and you have accepted these Terms, the Cancellation & Refund Policy, and the Accident Waiver and Release of Liability.

If you book on behalf of others or as part of a group, you represent that you have authority to accept these Terms on behalf of each traveler in your booking, and you are responsible for ensuring each traveler receives and accepts these Terms, the Cancellation & Refund Policy, and the Waiver. Each traveler remains individually bound.

JetQuest's Cancellation & Refund Policy is incorporated into these Terms by reference and governs all traveler-initiated cancellations, JetQuest-initiated cancellations, credits, and transfers. In summary (the full policy controls): full refund within 48 hours of booking; 50% trip credit (valid 1 year) for cancellations 90 or more days before departure; no refund, credit, or transfer for cancellations within 90 days of departure. Founders Circle enrollment is non-refundable.

JetQuest's Accident Waiver and Release of Liability is incorporated into these Terms by reference. By booking, you assume the inherent risks of domestic, international, and group travel — including but not limited to illness, injury, death, food poisoning, allergic reactions, infectious diseases, motor vehicle accidents, water-based activity accidents, hiking and outdoor activity accidents, altitude effects, exposure to wildlife, theft, robbery, assault, harassment, kidnapping, terrorism, civil unrest, war, weather events, natural disasters, transportation delays or failures, accommodation issues, vendor non-performance, and the criminal acts of third parties — and release JetQuest as set out in the Waiver.

You are solely responsible for: obtaining and carrying valid travel documents (passports, visas, entry permits); securing required vaccinations and complying with health regulations and travel advisories for the Trip and any destination; purchasing comprehensive travel and medical insurance; complying with the laws and customs of every destination; assessing your own physical, mental, and medical fitness for participation; and exercising sound personal judgment regarding your safety, possessions, alcohol consumption, and conduct.

JetQuest is not liable, and will not issue refunds, if you are denied boarding, denied entry, deported, or unable to participate due to documentation, vaccination, or health-screening failures.

JetQuest, the Host, or any vendor may remove you from a trip or event at any time for conduct that endangers, harasses, threatens, or significantly disrupts other travelers, staff, or third parties; violates local law; involves illegal substances; or breaches these Terms. If you are removed for misconduct, you forfeit all amounts paid, receive no refund or credit, and are solely responsible for the cost of return travel and related expenses.

While participating in a trip or JetQuest event, you may be photographed, filmed, or recorded. You grant JetQuest and its Hosts permission to use photographs, video, and audio recordings of you taken during the trip for marketing, promotional, and operational purposes, without compensation. If you do not consent, you must notify JetQuest in writing before the trip begins.

JetQuest reserves the right to modify accommodations, venues, itinerary details, or included activities at any time to maintain quality standards or respond to circumstances. Travelers will be notified as soon as reasonably possible. Modified trips are not eligible for refunds or credits as long as the overall trip experience and value remain comparable. Travelers who do not wish to participate in a modified trip may cancel under the standard Cancellation & Refund Policy based on the date of their cancellation, not the date of the modification. Trip listings, photos, and marketing materials are descriptive and illustrative; they are not contractual guarantees of specific experiences, accommodations, or outcomes.

Participation in the JetQuest Affiliate Program is governed by the affiliate terms presented at enrollment. Commissions are earned only on completed, fully paid bookings attributable to your unique referral link, and are void for self-referrals, fraudulent bookings, or bookings later refunded or charged back.

The Services and all content JetQuest provides — including the JetQuest name, logos, trip content, photos, video, text, and software — are owned by JetQuest or its licensors and protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works without our prior written consent.

You agree to defend, indemnify, and hold harmless JetQuest and its officers, directors, employees, agents, and affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from (a) your use of the Services; (b) your violation of these Terms; (c) your violation of any third-party right, including intellectual property, privacy, or contract rights; (d) any trip you organize or participate in; (e) any content you submit; or (f) any dispute between you and another user.

Initiating a payment card chargeback or payment dispute for a charge you authorized, in circumvention of the Cancellation & Refund Policy, is a material breach of these Terms. JetQuest may contest any such chargeback with the records of your agreement (including timestamp and IP logs), may suspend or terminate your account and future participation, and may pursue recovery of the disputed amounts plus reasonable costs of collection.

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Subject to Section 19, exclusive venue for any permitted court proceeding is the state and federal courts located in Harris County, Texas.

You represent that you are not located in, and are not a national or resident of, any country or region subject to comprehensive U.S. sanctions, and that you are not on any U.S. government restricted-party list (including OFAC's SDN list). You agree not to use the Services in violation of any applicable sanctions, anti-money-laundering, or export control laws.

JetQuest is not liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, epidemics or pandemics, war, terrorism, civil unrest, labor disputes, government actions, travel restrictions, or failures of transportation, utilities, or third-party suppliers. Remedies for trips affected by such events are governed by the Cancellation & Refund Policy.

Severability and reformation. If any provision of these Terms is held invalid, illegal, or unenforceable, the remaining provisions remain in full effect, and the parties intend that any unenforceable provision be reformed to the maximum extent enforceable. Entire agreement. These Terms, together with the Cancellation & Refund Policy, the Accident Waiver and Release of Liability, the Privacy Policy, and any offering-specific agreement, are the entire agreement between you and JetQuest. Changes. JetQuest may update these Terms from time to time; the "Last Updated" date will reflect the current version, and continued use of the Services after changes take effect constitutes acceptance. No waiver. Our failure to enforce any provision is not a waiver of it. Assignment.
