Accident Waiver & Release of Liability

This Accident Waiver and Release of Liability ("Waiver") is entered into between the undersigned traveler ("I," "me," "my") and JetQuest Travel LLC, a Texas limited liability company, together with its officers, directors, employees, agents, contractors, hosts, vendors, partners, representatives, and affiliates (collectively, "JetQuest"), in connection with my participation in any JetQuest trip, event, or experience (the "Trip").

In consideration of being permitted to participate in the Trip, I agree to each of the following:

I acknowledge that domestic, international, and group travel — and the activities offered as part of or in conjunction with the Trip — involve inherent risks that cannot be eliminated, including but not limited to: illness, injury, death, food poisoning, allergic reactions, infectious diseases, motor vehicle accidents, water-based activity accidents, hiking and outdoor activity accidents, altitude effects, exposure to wildlife, theft, robbery, assault, harassment, sexual assault, kidnapping, terrorism, civil unrest, war, weather events, natural disasters, transportation delays or failures, accommodation issues, vendor non-performance, and the criminal acts of third parties. I knowingly and voluntarily assume all such risks.

I certify that I am physically, mentally, and medically fit to participate in the Trip and its activities, that I have no condition that would create an unreasonable risk to myself or others, and that I have consulted a physician regarding any concerns. I am solely responsible for assessing my own fitness for each activity and for exercising sound personal judgment regarding my safety, possessions, alcohol consumption, and conduct.

I understand that the Trip may include or make available water-based activities (including swimming, boating, snorkeling, and similar activities). I understand that JetQuest is not responsible for providing lifeguards or other water safety measures and cannot ensure the functionality, safety, or usability of any devices, vehicles, vessels, or equipment that may be used during such activities. Any and all participation in water activities is at my own risk.

I understand and acknowledge that while JetQuest may take reasonable steps to support my safety during travel and during sponsored activities, these precautions are made in good faith and do not warrant or constitute any acceptance of liability, representation, or warranty, nor do they guarantee that the steps undertaken will demonstrate or constitute non-negligent performance.

I understand and acknowledge that JetQuest is not responsible for my safety, and I knowingly, voluntarily, and intelligently agree to assume any and all risks associated with travel and with participation in the Trip and any activity offered as part of or in conjunction with the Trip.

I understand that JetQuest may have created a specific itinerary for the Trip. I further acknowledge that any and all activities, excursions, or experiences I undertake outside of the JetQuest-sponsored itinerary — including activities I plan independently, undertake with other travelers, or that are encouraged by hosts but not part of the official itinerary — are taken at my own risk and at no responsibility to JetQuest. This includes activities undertaken before the Trip officially begins and after the Trip officially ends.

In the event of an emergency, I authorize JetQuest and its representatives to obtain or arrange medical treatment on my behalf, and I accept full financial responsibility for all costs of such treatment, evacuation, and related expenses. I release JetQuest from any liability arising from the provision, arrangement, or timing of emergency care.

I acknowledge that JetQuest engages independent third-party vendors, transportation providers, accommodations, and activity operators, and that JetQuest is not responsible or liable for the errors, omissions, acts, or failures to act of any such party.

I understand that while participating in the Trip and at JetQuest events, I may be photographed, filmed, recorded, or otherwise captured in audio, video, or still imagery. I grant JetQuest permission to use such imagery and recordings of me for marketing, promotional, and operational purposes, without compensation. If I do not consent, I must notify JetQuest in writing before the Trip begins.

I remain responsible for all amounts I owe for the Trip under the JetQuest Cancellation & Refund Policy, and I acknowledge that this Waiver does not create any refund right.

I understand that government travel advisories, entry requirements, health regulations, and visa requirements may exist or change for the Trip and any destination. I accept full responsibility for monitoring and complying with all such advisories, entry requirements, vaccination requirements, and visa requirements.

I agree to comply with all laws, regulations, and customs of every destination visited during the Trip, and I am solely responsible for the consequences of any violation.

I understand that I may be removed from the Trip at any time by JetQuest, the host, or any vendor for conduct that endangers, harasses, threatens, or significantly disrupts other travelers, staff, or third parties; violates local law; involves illegal substances; or breaches the JetQuest Terms & Conditions. If I am removed for misconduct, I forfeit all amounts paid, receive no refund or credit, and am solely responsible for the cost of return travel and any related expenses.

I acknowledge that I am solely responsible for ensuring I hold a valid passport, all required visas and entry permits, current vaccinations, and any health clearances required for each destination. I understand that JetQuest is not liable and will not refund any amounts if I am denied boarding, denied entry, deported, or unable to participate due to documentation, vaccination, or health-screening failures.

I understand that JetQuest strongly recommends I purchase comprehensive travel insurance, including coverage for trip cancellation, trip interruption, medical emergencies, evacuation, and lost baggage. JetQuest does not provide travel insurance. I accept that my failure to obtain travel insurance does not create any refund or compensation obligation on JetQuest's part.

I agree that this Waiver is governed by the laws of the State of Texas, without regard to its conflict-of-law principles. Any dispute arising out of or relating to this Waiver is subject to the dispute resolution, arbitration, class-action waiver, and venue provisions in the JetQuest Terms & Conditions (https://jetquest.net/terms). If any provision of this Waiver is held to be invalid, illegal, or unenforceable, the remaining provisions remain in full effect, and the parties intend that any unenforceable provision be reformed to the maximum extent enforceable.

I, the undersigned, have voluntarily and without duress agreed to this ACCIDENT WAIVER AND RELEASE OF LIABILITY. I assert that I have read and fully understand it, that I have had the opportunity to ask questions and seek independent legal advice, and that I agree to accept its terms in full and of my own free will. I am at least 18 years old and legally able to enter this Waiver.
